Driver License Restoration

Trying to get your driver license restored can be one of the most difficult and stressful challenges to overcome. The Secretary of State is extremely strict on Driver License Restoration Hearings, and they often seem to look for any possible reason to deny a request. You can Appeal a Secretary of State denial to the Circuit Court, but that right to Appeal is very limited. The Appeal is not “de novo,” which means: “looking at the entire case new all over again.” In the Appeal, the Circuit Court is only allowed to look at the record that was made during the Secretary of State Hearing. In order to win the Appeal, you must prove the Secretary of State: 1) violated the United States or Michigan Constitution, or a statute; or 2) exceeded their authority or jurisdiction; or 3) made an unlawful procedure resulting in material prejudice; or 4) made a decision that was not supported by competent, material and substantial evidence; or 5) made a decision that was arbitrary, capricious or clearly an abuse or unwarranted exercise of discretion; or 6) made a decision that was affected by some other substantial and material error of law. Here is a link to the applicable Statute, MCL 257.323 (MCL stands for “Michigan Compiled Laws”). Further, the Statute requires the Judge to either deny the Appeal, or grant the driver a full-blown license with no restrictions whatsoever. Many Judges are simply not willing to risk their careers on people who lost their license as a result of multiple drinking and driving convictions.
